{"id":261699,"date":"2025-07-18T14:26:53","date_gmt":"2025-07-18T11:26:53","guid":{"rendered":"https:\/\/maritimes.gr\/?p=261699"},"modified":"2025-07-18T14:26:53","modified_gmt":"2025-07-18T11:26:53","slug":"fueleu-maritime-key-updates-on-fuel-certification-methane-slip-and-exemptions","status":"publish","type":"post","link":"https:\/\/maritimes.gr\/en\/fueleu-maritime-key-updates-on-fuel-certification-methane-slip-and-exemptions\/","title":{"rendered":"FuelEU Maritime: Key updates on fuel certification, methane slip, and exemptions"},"content":{"rendered":"<p>With the FuelEU Maritime regulation in force, questions around reporting requirements, fuel allocation, exemptions and fuel certification have become increasingly common. In response to feedback and concerns from our customers, this statutory news aims to clarify these aspects of the regulation and provide guidance on compliance.<\/p>\n<p>Relevant for ship owners and managers.<\/p>\n<p><strong>Fuel allocation and certification<\/strong><\/p>\n<p>Two guidelines have recently been completed by the European Sustainable Shipping Forum (ESSF) and are now published. The two guidelines are:<\/p>\n<p><strong>1. Report on calculation methodologies under Regulation (EU) 2023\/1805 (FuelEU)<\/strong><br \/>\nFirst, a recently published report on calculation methodologies under FuelEU provides guidance and best practices to\u00a0understand and implement the calculation as set out under\u00a0the regulations. The guideline provides crucial information\u00a0to those calculating the actual vessel performance. We\u00a0recommend that our customers familiarize themselves with\u00a0the report, in particular with the principles of fuel allocation\u00a0under FuelEU, as illustrated below.<\/p>\n<p>While the illustration has been taken from the\u00a0DNV white\u00a0paper on FuelEU Maritime, its content is consistent with the\u00a0one provided in the report of calculation methodologies\u00a0under FuelEU (note: DNV has actively contributed to the\u00a0development of the ESSF report). The ESSF report additionally\u00a0provides guidance on the regulation\u2019s technical requirements,\u00a0including the use of renewable and low-carbon fuels, voyage\u00a0specific exemptions, and flexibility mechanisms such as\u00a0banking, borrowing and pooling. See the \u201cResources\u201d section\u00a0below featuring a link to the report. More guidance from the\u00a0European Commission is expected in the second half of 2025.<\/p>\n<p><strong>2. Report on Marine Fuels Certification Procedures to support implementation of FuelEU Maritime<\/strong><br \/>\nThe second key guideline is relevant both to FuelEU Maritime\u00a0and the EU ETS. One of the key topics covered in this report\u00a0is fuel sustainability certification. The document provides a\u00a0template for Proof of Compliance (PoC), which can be used\u00a0instead of Proof of Sustainability (PoS) in the event that the\u00a0fuel in question is also used by the fuel supplier for compliance towards the requirements under the Renewable Energy\u00a0Directive. If the PoS is not available, it is recommended to\u00a0always follow this PoC template to avoid issues with fuel eligibility under FuelEU and the EU ETS.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.dnv.com\/contentassets\/3278feac378a4f80a5f9128dd7b51090\/image.png#1752666715567#1752666732027#1752666788881#1752666794607#1752666806270#1752666806341#1752666839414\" alt=\"Illustration of the most beneficial fuel allocation within the FuelEU energy scope\" width=\"802\" height=\"316\" \/><\/p>\n<p><em>Illustration of the most beneficial fuel allocation within the FuelEU energy scope (source: DNV white paper on FuelEU Maritime)<\/em><\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.dnv.com\/contentassets\/3278feac378a4f80a5f9128dd7b51090\/blobid1.png?1752666806432#1752666839414\" alt=\"Illustration of certification flow and how PoC (brown document) can substitute the need for PoS (blue document)\" width=\"806\" height=\"310\" \/><\/p>\n<p><em>Illustration of certification flow and how PoC (brown document) can substitute the need for PoS (blue document) (source: Report on Marine Fuels\u00a0<\/em><em>Certification Procedures to support implementation of FuelEU Maritime)<\/em><\/p>\n<p>Additionally, this report outlines procedures for certifyingrenewable and low-carbon marine fuels in line with FuelEU\u00a0Maritime and the EU ETS. Overall, it provides practical\u00a0instructions for fuel suppliers and shipping companies\u00a0regarding the required documentation, sustainability\u00a0certification, and traceability.<\/p>\n<p><strong>Certification of actual methane slip values<\/strong><br \/>\nUntil international standards are available, the FuelEU and\u00a0EU ETS regulations currently only allow for the use of default\u00a0methane slip values by engine type. Although the IMO guidelines for measuring methane slip from LNG engines were\u00a0adopted at MEPC 83 in April, the guidelines lack:<\/p>\n<ul>\n<li>procedures for on-board monitoring of emissions\u00a0(performance of after-treatment systems),<\/li>\n<li>methods to ensure that values remain stable over time\u00a0(due to engine modifications), and<\/li>\n<li>standardized test cycles.<\/li>\n<\/ul>\n<p>Following the above, the European Commission is working on interim guidelines to allow certification of actual values based on the IMO protocol. The guidelines are expected to be available in the second half of 2025.<\/p>\n<p><strong>FuelEU report submission enabled in Thetis \u2013 DNV is ready to receive FuelEU partial reports<br \/>\n<\/strong>When there is a change in company (e.g. due to sale of the vessel), a verified FuelEU report shall be recorded in the FuelEU\u00a0database within one month after the change of company.<\/p>\n<p>As of 18 June, the FuelEU database, which is part of the Thetis\u00a0platform, has been updated to support FuelEU Maritime partial reports. Consequently, the FuelEU Maritime service under\u00a0Fleet Status on Veracity has been adjusted to receive and\u00a0process FuelEU partial reports from customers. Companies\u00a0may now request the FuelEU partial report verification from\u00a0our customer portal.<\/p>\n<p>On 24 June 2025, EMSA and DG MOVE hosted a webinar on\u00a0FuelEU, presenting a high-level overview of the FuelEU report\u00a0and compliance balance modules in Thetis. We encourage\u00a0our customers to view the\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=os-r7yqD0jA\" target=\"_blank\" rel=\"noopener\">recording<\/a>\u00a0for further insights.<\/p>\n<h3>Clarifications on implementation<\/h3>\n<p><strong>Use of flexibility mechanisms<\/strong><br \/>\nIt is important to note that the use of pooling will not always result in a ship compliance balance of zero. A compliance surplus available after pooling can be banked for future use, while a deficit will trigger a penalty payment. Both borrowing and pooling come with limitations however \u2013 for example, borrowing is not permitted after pooling has been applied. The figure on the next page focuses on illustrating the key\u00a0limitations and options available.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.dnv.com\/contentassets\/3278feac378a4f80a5f9128dd7b51090\/blobid2.png?1752666806433#1752666839414\" alt=\"Flexibility mechanisms - possibilities\/principles\" width=\"659\" height=\"642\" \/><\/p>\n<p><em>Illustration of the FuelEU flexibility mechanisms workflow<\/em><\/p>\n<p><strong>Delay in FuelEU incorporation in the EEA Agreement<\/strong><br \/>\nNorway and Iceland are currently excluded from the FuelEU\u00a0Maritime regulation, as they have not yet been incorporated\u00a0into the EEA Agreement. Until then, Norwegian and Icelandic\u00a0ports are treated as third-country ports.<\/p>\n<p>Once incorporated, FuelEU will apply to 100% of energy used on voyages between EU and EEA ports, but no retroactive application is expected. The EEA Joint Committee, responsible for incorporating EU legislation into the EEA Agreement, has meetings scheduled throughout 2025. However, no official date has been confirmed for the incorporation of the\u00a0FuelEU Maritime regulation.<\/p>\n<h3>Exemptions to the FuelEU regulation<\/h3>\n<p>While derogations under the EU ETS are already well established, it is important to emphasize that FuelEU exemptions\u00a0differ from those of the EU ETS. To ensure proper compliance,\u00a0it is essential to understand the key exemption principles and\u00a0respective exemption lists published by the individual member states. Below are some core principles:<\/p>\n<p><strong>Outermost Regions exemptions<\/strong><br \/>\nOutermost Regions (OMRs), like the Azores or the Canary Islands, are territories geographically distant from continental Europe but are an integral part of the EU. In general, for voyages that start or end in an OMR, only 50% of the energy used on such voyages is included in the regulation\u2019s scope (Article 2(1)(c)).<\/p>\n<p>The member states France, Portugal and Spain have requested temporary exemptions (until 31 December 2029) for specific ports and routes located in nine OMRs.<\/p>\n<p>They apply to energy used on voyages between ports of call in OMRs and within those ports. The exemptions can be found here for\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=OJ:C_202500357\" target=\"_blank\" rel=\"noopener\">France<\/a>,\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=OJ:C_202500358\" target=\"_blank\" rel=\"noopener\">Portugal<\/a>\u00a0and\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=OJ:C_202503449\" target=\"_blank\" rel=\"noopener\">Spain<\/a>.<\/p>\n<p>Additionally, under the FuelEU regulation, any port of call in an OMR port included in the above list is fully exempt from the regulation\u2019s energy scope. In contrast, the EU ETS only exempts ports of call in relation to an exempted voyage falling under the scope of the derogation.<\/p>\n<p>The table below shows two scenarios and the percentage of energy included for each step under the FuelEU scope:<\/p>\n<p><em><img decoding=\"async\" src=\"https:\/\/www.dnv.com\/contentassets\/3278feac378a4f80a5f9128dd7b51090\/blobid3.png\" alt=\"Examples of different OMR voyage scenarios\" width=\"804\" height=\"135\" \/><\/em><\/p>\n<p><em>Examples of different OMR voyage scenarios<\/em><\/p>\n<p>In the first scenario, there is an into-EU voyage between an\u00a0OMR port and a US port. Therefore 50% of energy is included\u00a0under the FuelEU scope according to Article 2(1)(d). Since Las\u00a0Palmas is included in the exemption list, the energy contribution for a port stay within that OMR port is 0% under Article\u00a02(4) and applies regardless of the previous or next port of\u00a0call. The second part of the voyage of the first scenario is an\u00a0intra-EU voyage between an OMR and an EU port of the same\u00a0member state. For this reason, Article 2(1)(c) applies.<\/p>\n<p>In the second scenario, there is an intra-EU voyage between\u00a0two OMR ports included in exemption lists which results in\u00a00% of energy under FuelEU. This is according to Article 2(4)\u00a0and a temporary exemption until 31 December 2029.<\/p>\n<p><strong>Other exemptions<\/strong><br \/>\nThe FuelEU regulation allows member states to request other\u00a0exemptions for voyages between small islands (eight countries\u00a0have requested exemption), and voyages under public service\u00a0contract \/ obligation (six countries have requested exemption).\u00a0These exemptions are pursuant to FuelEU regulation Articles\u00a02(3), 2(5) and 2(6) and will expire by 31 December 2029.<\/p>\n<p>For more information about exemptions and voyage scenarios,\u00a0please refer to Chapter 2 in the ESSF report on calculation methodologies (see link under the \u201cReferences\u201d section below).<\/p>\n<h3>Recommendations<\/h3>\n<p><strong>1) Ensure alignment on internal processes and contracts<\/strong><\/p>\n<ul>\n<li>Check that your in-house or outsourced calculations reflect the outlined principles. The same principles should be reflected in the commercial contracts.<\/li>\n<\/ul>\n<p><strong>2) Monitor regulatory developments<\/strong><\/p>\n<ul>\n<li>Follow updates for methane slip certification.<\/li>\n<li>Stay up to date with the incorporation of the FuelEU regulation in Iceland and Norway.<\/li>\n<li>Familiarize yourself with latest resources available on the European Commission\u2019s website, including fuel allocation principles under the FuelEU regulation.<\/li>\n<\/ul>\n<p><strong>3) Ensure accurate and timely reporting<\/strong><\/p>\n<ul>\n<li>Follow up on FuelEU partial report verification in case of\u00a0change of companyIf bunkering alternative fuels, make sure that fuel eligibility\u00a0criteria are fulfilled by requesting a PoS\/PoC from your fuel\u00a0supplier.<\/li>\n<li>If bunkering alternative fuels, make sure that fuel eligibility\u00a0criteria are fulfilled by requesting a PoS\/PoC from your fuel\u00a0supplier.<\/li>\n<li>Ensure that respective exemptions are incorporated in your\u00a0performance monitoring\/reporting systems.
